Topic: Bought a card from TrollAndToad on eBay. Got message they are OOS!?

So, I BIN'ed an Italian Abyss for my playset collection.Payment went fine, used my CC, now I get this by email 24 hours later: This is to notify you that we are unfortunately out of the product that you ordered. We are inquiring as to whether you wanted to replace this product with something else? Or did you want to receive a full refund? Please be aware that the paperwork for your order will be in Customer Service for the next 48 hours awaiting your response. If we haven't heard from you within the allotted time, your order will be canceled and you will receive a full refund. All apologies for any inconvenience caused by this matter. Have a nice day.
Anyone had this happen? What do I do? First time I've seen this. Edit: Just an update. I got an email today, and they have received more, and will ship it to me Priority Mail, free of charge. Very impressed

Their ebay inventory is the same as their store inventory, so it probably sold out in their store right before you bought them.__________________ Looking for misprinted Commander decks. Got one? Talk to me.

Their inventory seems to be pretty well updated from their online store to their Ebay listings. I purchased a card and the Ebay listing was gone almost immediately (it was gone before I could check Ebay 5 to 10 seconds later). It sounds like you just ran into an outright error in inventory.

This happened to me last week with them also.Unfortunately, due to an error in our inventory, we are currently out of stock on an item or items in your order (#43945159). Below is an itemized list of the item or items that we discovered missing. Missing Item(s): * 12 x - Sutured Ghoul Resolution: Refund will be issued: $6.84 A refund will be issued within 48 hours after your order has shipped.

Side question. Why buy from them on ebay when their website prices are usually 8-10% lower than their ebay prices?

ebay's subsidiary that works with website's to link inventory through the website is not perfect. If they're updating their servers, or you have a few seconds of downtime on your own server when something sells, then it can cause an inventory error.Ebay also can glitch and oversell items. If you want to buy from a shop always buy direct since it will cost you 8-12% less than buying from shops through ebay.

Well depending on whether or not you feel you got a good enough deal to pursue this, most states have laws where an auction through a certified auction house is a contract. There fore Troll and Toad would owe you this card or face the penalties of breaking a contract. Under these laws they simply can not change the final agreement without your consent. So basically if they reside in a state where these laws are applicable you could demand that they send you the cards regardless of how much it costs them. That is their problem. Like I said I don't know if you got a deal good enough to follow up but food for thought.

Hm, that's interesting. Not sure if it applies to Kentucky. I'm a bit peeved at them that I won a bunch of auctions a while ago for some cheap stuff, I asked them to combine shipping, got no response *and* an unpaid item strike. Seriously? I'll see what I can do. Also, I bought on eBay because I assumed that the store stock was not updated as frequently, vs the eBay stock. Now, I passed on a deal to buy 4 Abyss because I was already getting one, and there would be no reason to have three extras. Now I'm back to needing two. Inventory issues happen. I was selling an entomb a while back, and copied the listing by mistake. I had over 250 auctions up at that time, and never caught it til the guy paid for an item I didn't have. I have made trades on MOTL and was unable to find a card when I need to ship. Mistakes happen. I've bought from Troll and Toad about 100+ times, and never had an issue. __________________ "I don't ship to PO Boxes."HUH! mail under lock and key, or out by the road.... this is a hard one.

Also, 99.999% of the neg feedback comments I read are written by people who clearly showed no patience for the situation and just fired something off. __________________ Wisconsin - smells like dairy air!

It happens to me sometimes when I do the opposite, buy from their store (something of theirs I see on ebay) and someone buys it off ebay before me.99% of the time things are fine. Like someone said, honest mistakes happen. Take the refund and go elsewhere, leave a neutral.

Yup. Once I got a neg from a guy who mailed me once in inchoherent english about "how do I pay?!?!". So I say, please pay by paypal per the auction, here's their website, blah, blah, and he negs me!. Poot.

While this is always an option, please note that this was an honest mistake and if you sue a company for failing to comply, it will not only be thrown out of most courts, but you may get blacklisted from buying from many online retail sites. The cost of the suit would cost more than the benefit and unless you could actually prove you were harmed by it (missing out on a different playset would not count) then you could not receive punitive damages. On a last note, try not to hold purchases of OOS items against shops regardless of who they are.

I wouldn't take any action beyond giving neutral/negative feedback. But I'd probably go with negative. *shrugs* I don't have a lot of sympathy for stores that screw up, especially considering your prior experience with them on the unpaid item strike.

Now there is a 2nd item I ordered from the same order that hasn't shipped yet that is out of stock with refund AND I paid via paypal and got an Unpaid Strike for EVERY auction because ebay said that troll and toad did not post they received the payment. This is after troll and toad told me to send them different payments for 17 different items and they would refund the shipping charges for 16 of them. I said F that there is no way I am sending all that. This has been a nightmare of a purchase. This is my email to them:This is f@#$ing bulls#%t. This is the 2nd item I ordered and you did not have this order. I also got an unpaid item strike for EVERY auction I won from you guys even though YOU said to send you the payment via paypal and I paid. I am leaving negative for everything and never f@#$ing ordering from you again. Ship the f#%#ing order and keep the $1.00 and shove it up your a#%.
