could someone link me to the rules where it states clearly that once address's are exchanged a deal cannot be backed out of?

I have searched the 'rules' link at the top of the page and read through both pages thoroughly and read nothing of that.

okay that link rule #11 has helped. thank you.

Question, however:

We have exchanged address, then he asked me condition of cards. I have not sent as I have not recieved a confirmation reply that the condition of my cards was acceptable. Am I in violation of these rules?

It depends and is honestly quite open to mod interpretation if it advanced to a BTA case. How long have you given them to respond? What did your trading partner say when asking about condition? Was it more of a "lmk if the cards are not NM" type of statement?

It has not advanced to a bta case. I have my cards packaged and ready to go. He stated that as long as they were EX+ he would do this trade. I have slight edge wear and very faint whitening, so I wanted his opinion before sending. that was on thursday. I messaged him again asking for a comfirmation after describing the cards and have not received on. I messaged him again today to say that I can wait another two days (since it is the weekend) before I will have to cancel this trade as I have not received a confirmation that he agrees that the condition is acceptable. he sent his address in the same post as a question towards the condition. So I am stuck waiting for a response where I am also supposed to send, but I am not going to do a trade with someone just to have them not be happy at the end because of a delay in communication. I would rather just not do that trade. However I do not want a BTA on my account either, so I need some advice.

You're doing the right thing by waiting patiently. Based on your description, it sounds like the deal was not finalized completely because the condition question was raised when he sent his address. That does give you an "out" if they have not responded in a timely manner.

In your position, I would reach out via e-mail a few more times and wait at least a 2-3 days more before canceling the deal (if you never hear anything back from them). Basically, you need to document that he raised an issue that could be a deal breaker. You need to be reasonable in giving him time to respond, but you don't have to wait a week for an answer.

how many days would be appropriate, as it has been 3 days now and monday would be 5 days. I feel that that would be substantial myself.

Monday is probably overkill, but it also covers you. Have you only sent one message in response? I would follow up as they may not realize you are waiting for one.

No, I have sent two messages now. One directly after he had asked about condition, and another today.

I think you're doing everything right and giving him ample time to respond. I only say wait until Monday as it's the weekend and not everyone is sitting in front of a computer all the time checking e-mail.

To avoid a situation like this again, I would be open about any card conditions less than NM before it gets to the point of confirming a trade. It will be a factor frequently for people when trying to decide if a trade is worth doing and should not be a last minute detail.

Without seeing the entire negotiations and everything, I can't say for sure, but it sounds to me like there's a confirmed trade, and backing out would be very bad.

If the deal was agreed to and addresses exchanged before condition came up, it's too late for him to worry about condition. Per MOTL rules, if condition is not discussed, EX or better is assumed. If it matters, it needs to be negotiated beforehand.

Seeing the actual e-mail chain would be necessary in this case, so I understand the need to air on the side of "confirmed deal."

However, isn't he running the risk of getting thrown up on the BTA anyway if he sends cards that are EX, but not EX+ since that seems to matter? I mean, chances are good he'd beat the case, but it seems like it would end up being more of a hassle than just getting this guy to e-mail him back.

Without a response from the other party, there's really not a lot that can be done, but assuming that there's nothing in the communications that would suggest it wasn't a confirmed trade, I'd personally much rather risk a bogus BTA case where I'm in the right than a valid BTA case where I'm wrong.

thanks for the help guys, and I will keep it in mind for the future. just to update he messaged me and said the trade is confirmed and it is all good.
